Terms of Service and Policies for Nevada Roots

Nevada Roots clients who have signed a Quote/Estimate Sheet or Acknowledged in writing their acceptance of proposed quote for tree services are subject to the rules and terms of that agreement which supersedes any general terms and conditions stated here. Review the following terms of service before proceeding with Nevada Roots services. The following terms of service will apply to the agreement to provide service between Nevada Roots, and the individual or business entity (“Client”) identified on the quote or estimate for said services. These terms, shall hereinafter be referred to as the “Agreement” between the two above mentioned parties.

 

  1. SERVICE RATES: Client acknowledges that they have been made adequately aware of the initial rates and fees associated with services being rendered by Nevada Roots and have received a complete description of services to be rendered. Client also acknowledges that Nevada Roots reserves the right to change the specified rates and changes from time to time. Any promotional offers made by Nevada Roots are contingent upon Nevada Roots maintaining its cost of service goals, including but not limited to rates charged by its vendors and service providers. Where possible, Nevada Roots will provide the Client with a minimum of 15 days' notice of any rate changes. In the event that a Nevada Roots service is mistakenly listed at an incorrect price, Nevada Roots reserves the right to refuse or cancel any requests placed for service listed at the incorrect price. Nevada Roots reserves the right to refuse or cancel any such service requests whether or not the request has been confirmed and your payment processed. If your payment has already been processed for the service and your request is cancelled, Nevada Roots shall issue a credit to you in the amount of the incorrect price.

  2. PAYMENTS AND FEES: Client acknowledges that Nevada Roots is under no obligation to provide services under the terms of this Agreement until quoted deposits or required payments have been paid-in-full, and Nevada Roots has been able to adequately verify the validity of said payment. Any Client account that becomes past due beyond 15 days is subject to a 10% late payment fee, not to exceed $50, and a Client account that becomes past due at 45 days or beyond is subject to be suspended or disabled for non-payment at any time at the sole discretion of Nevada Roots.

  3. REFUND POLICY: Since Nevada Roots offers non-tangible, irrevocable services, we do not issue refunds once a service is rendered. As a client, you are responsible for understanding this upon agreeing to quotes for services. Many services provided by Nevada Roots do not require payment until after services have been delivered or rendered. In the case that Client payment is made prior to services being delivered or rendered, we realize that exceptional circumstances can take place with regard to the character of the services. Therefore, we do honor requests for refund based on the following reasons: 1) Unfulfillment of the service due to unforeseen or emergency circumstances which prevent the rendering of the service within the agreed upon and necessary time of rendering. Claims for unfulfillment must be submitted to Nevada Roots in writing within 7 days from the agreed upon date of service fulfillment. Otherwise, the service will be considered received and fulfilled. 2) Services not as described. Such issues should be reported to Nevada Roots within 7 days from the agreed upon date of service. Clear evidence must be provided proving that the service rendered is not as it is described on the quote or agreement issued between Client and Nevada Roots. Claims that are based merely on the Client’s expectation or wishes that were not communicated prior to service are not honored. Please note that we do not bear any responsibility and therefore we do not satisfy any refund requests based on incompatibility of our services and service outputs as they may relate to any business or technical function of the Client. As a services company, we are always eager to assist you and deliver highly professional and competent services and support in a timely manner and are willing to offer expertise and consultative advice where appropriate in order to maximize your results as they may relate to use of our services. In accordance with the above Terms and Conditions, any requests for refunds may be emailed to jenelle@nvroots.com and should include the detailed and grounded reasons why a refund is warranted.

  4. SERVICE CANCELLATION: Requests to cancel services that are not made binding by a signed quote or written acceptance may be made by notifying Nevada Roots via email at info@nvroots.com or jenelle@nvroots.com, or calling at 775.560.9538. All requests for service cancellation must be made a minimum of 3 business days prior to the scheduled date of service. 

  5. BILLING ERRORS: Client acknowledges that Nevada Roots will make its best effort to ensure that all invoices are correctly issued. Should Client note any possible errors, Client agrees to notify Nevada Roots within 15 days of the issuance of the errant invoice. After 15 days, all invoices will be assumed to be correct, and no further billing adjustments will be made.

  6. CREDIT CARD PAYMENTS: Invoices will be emailed to the Client in conjunction with a link to pay with a card through an online virtual platform. Should the Client’s credit card be declined for any reason, Company will contact Client to notify them of the declined charge, and the Client will be required to provide an alternative means of payment via a different credit card, a check, or cash.

  7. INDEMNIFICATION: Under no circumstances shall Nevada Roots be held liable for damages resulting from any interruption of service for an amount greater than the amount of the charges payable by the Client for services during the period damages occurred. Client also acknowledges that in no case will Nevada Roots be liable for damages as a result of its own negligence in excess of the charges payable by the Client for services during the period damages occurred. Client acknowledges that they make use of Company’s services at their own risk. 

  8. NO LEASE IMPLIED: Client acknowledges that Nevada Roots is providing a service, and no binding lease of physical equipment is in any way implied as part of this agreement unless otherwise represented in a User Agreement signed by both Company and Client.

  9. PRIVACY POLICY: Nevada Roots’ does not share or sell any Client information.

  10. VIOLATION OF TERMS: Should Client violate any of these terms, Nevada Roots will attempt to contact the Client by email or telephone before taking any action where avoidable. However, Nevada Roots will pursue whatever action is necessary to serve its best interest in these cases, even if that should necessitate the suspension or termination of Client’s services without any type of notification.

  11. PRIVACY POLICY: We receive, collect and store any information you enter on our website or provide us in any other way. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, communications) that you submit on our form, comments, feedback, reviews, or recommendations. Payment details used through our invoicing website only provide a token number to us, never your card number.

 

When you conduct a transaction via an invoice sent through our processing system, as part of the process, we collect personal information you give us such as your name, phone number, address and email address. Your personal information will be used for the specific reasons stated above only.

 

We collect such Non-personal and Personal Information for the following purposes:

  • To provide and operate the Services;

  • To provide our Users with ongoing customer assistance and technical support;

  • To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  • To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

  • To comply with any applicable laws and regulations.

 

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to provide information about our services. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  

 

Any direct payment gateways used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our business and its service providers.

 

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
